1. The agreement

These terms are an agreement between you and Wellbrad LLC ("we") for the myReps app and this website. By using myReps you accept them. The Privacy Policy explains how we handle data.

2. Who can use myReps

You must be at least 13 years old, or older where your country sets a higher age for consenting to data processing. If you are under 18, a parent or guardian must agree to these terms for you.

3. Not medical advice

myReps is a training log. It is not a doctor, a physiotherapist or a personal trainer, and nothing in it, including generated routines, exercise videos and heart-rate figures from Apple Health, is medical advice or a diagnosis. Strength training carries a risk of injury. Talk to a qualified professional before starting or changing a programme, stop if you feel pain, faint or unwell, and choose weights you can control. You train at your own risk.

4. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use myReps on Apple devices you own or control, as the App Store's usage rules allow. We and our licensors own the app, its design, the exercise library and its videos.

5. Rules of use

Do not copy, resell or redistribute the app or its exercise library; reverse engineer it except where the law allows; scrape or overload our services; upload anything unlawful or that you have no right to share; or try to reach another person's data.

6. Your content

Your training data is yours. When you send us something, such as an exercise request with a video, feedback, or an imported file, you give us a worldwide, royalty-free licence to host, process and use it to run and improve myReps, including adding a requested exercise to the library for everyone. Feedback posts are public. Do not send us anything you do not have the right to send.

7. Subscriptions

Every feature is available to everyone; a subscription removes ads. Subscriptions are sold by Apple, renew automatically until cancelled, and are refunded only by Apple. Details: Subscriptions and refunds.

8. Third-party services

myReps works with services we do not control, including Apple Health, Sign in with Apple, Google sign-in and links you choose to import from. Their terms apply to your use of them.

9. Apple

These terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and, to the extent the law allows, has no warranty obligation beyond refunding the purchase price if the app fails to conform to a warranty. We, not Apple, are responsible for product claims, including product liability, legal or regulatory compliance, consumer protection, and claims that the app infringes intellectual property. You confirm that you are not in a country under a US Government embargo or designated as terrorist-supporting, and are not on a US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

10. Ending the agreement

You can stop at any time by deleting your account and the app. We may suspend or end access if you break these terms or if we stop offering myReps. A subscription already paid for runs to the end of its period under Apple's rules. Sections that by their nature should survive, do.

11. No warranty

myReps is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise the app will be uninterrupted, error-free, or that data kept only on your device can be recovered if the device is lost.

12. Liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, for lost data, or for personal injury arising from your training. Our total liability for any claim is limited to the greater of what you paid us in the 12 months before the claim and US$50. Nothing here limits liability that the law does not allow to be limited, or rights you have as a consumer where you live.

13. Indemnity

You agree to cover our losses from claims caused by your breach of these terms or by content you sent us unlawfully.

14. Changes

We may update these terms. Material changes are announced in the app before they take effect; continuing to use myReps after that means you accept them.
